Your Attorney in India

Mr. Sunil Agrawal will be your personal attorney in New Delhi who will look out for your best interest. He represents you when you cannot physically be in India. This is quite important to have in a country where the pace is not the same as you’re used to. Sometimes things need a push, and you will have representation on the ground in India to service your needs when you’re not there. Any issues that arise due to lack of communication or non-agreement on your contract will be handled by Mr. Agrawal and reported back to you immediately so that potential problems can be resolved quickly.
The following services are included in the full package price:
- Reviewing of all hospital/surrogate charges and additional costs and making sure the charges and payments are fair to the Intended Parents (IPs).
- Drafting and notarizing of all written contracts between the intended parents (IPs), the surrogate, donor (if applicable), hospital, and the attorney.
- Drafting and notarizing of any special contracts, affidavits and/or documents additionally required by your embassy, consulate or high commission of your home country.
- Ensuring that all contracts are properly and officially stamped for use at the embassy, consulate or high commission of your home country.
- Being present during all contract signing and negotiations. He can be a translator to you in Hindi if communicating to the surrogate or her family.
- In all scenarios, he is your legal representative and will work on your behalf regarding negotiation or point of contact. All communication can be done through Mr. Agrawal and will be relayed back to you for confirmation or approval. This will set a formal and legal tone to all contracts and meetings between all parties when you cannot be physically present in India.
- Being present at the birth of the child, obtaining the Indian birth certificate expeditiously and ensuring that the birth certificate has the intended parents’ names listed on it.
- When the baby is born, ensuring that you receive all necessary documents and records from the hospital for the purpose of the baby’s immigration back to your home country.
- Handling the Indian exit visa process for your baby.
- Ensuring that the hospital and surrogate follow all obligations outlined in the signed contracts and reporting any conflicts that may arise.
- Includes four meetings or hospital visits, mobile phone usage, and daily transportation with you and/or your partner or spouse.
- 24 hour emergency support for you and your partner/spouse during your stay in India.
For an additional fee, he can provide:
- Additional visit with the doctor for medical reports or results on the surrogate and the pregnancy and sending those reports to you in a timely manner. All surrogate’s medical records should be accessible to you from the start of the surrogate’s investigation to her entire term of pregnancy. Records and test results can be obtained per your request.
- Additional visit with your surrogate or surrogate coordinator per your request.
- Having an additional meeting outside the basic package with you and/or your partner or spouse when you are in New Delhi.
Background
Mr. Sunil Agrawal has been an attorney in India for over 20 years in the area of family law, personal property, commercial/business law, and now surrogacy cases. He received his bachelor’s and law degree from Delhi University and has been practicing since 1986. Of particular interest is that he worked many years defending the Municipal Corporation of Delhi (MCD), where birth certificates are issued. He was responsible for helping people obtain their birth certificates in a timely manner, which is very useful experience regarding surrogacy, since the birth certificate is the key document to bring your baby home. He became involved in surrogacy cases because of his sister, who resides in the U.S., is a close personal friend of the owner of Karma of Baby LLC and represented the owner during her surrogacy journey.
Mr. Agrawal is married with two teenage children living at home. He enjoys traveling abroad, reading and spending time with his family. He appreciates a good sense of humor and values life and family above all else. He is very close to his sisters and father, who was a world journalist and worked with the Times of India Group newspaper, Nav Bharat Times. His personal beliefs regarding surrogacy are that everyone should have the opportunity to have children and that everyone should be treated equally.
